ThmIndxr^TM License Agreement

This is a summary of the license agreement which is presented in full below.

ThmIndxr^TM is distributed as a shareware program, allowing you to try it before you buy it, to determine if it meets your needs. The demo version expires after 10 days, or after creating 50 HTML pages, whichever comes first. This should give you ample opportunity to experiment with the program. There are no other operating restrictions on the demo version, which is fully functional.

After the demo version expires, you will need to get a User ID and a Registration Key to continue using the program. Your Registration Key will be sent to you via email as soon as your registration form is received, along with instructions on how to install the key in your system.

ThmIndxr^TM's shareware license grants you the right to use the program to create as many HTML pages as you wish to within the demo mode limitations. However, if you publish ANY of the pages it creates, whether on the World Wide Web, on an intranet, on a CD-ROM, or on any other form of electronic media, you are obligated to register your copy of the program and pay the registration fee.

ThmIndxr^TM is guaranteed to perform substantially as is described in its documentation, and on its Web page. If an operating error occurs, L5 Software will make a reasonable effort to correct the problem. We are also open to suggestions or requests for future enhancements. The printed documentation contains instructions for reporting bugs or contacting the company for other reasons.

Before downloading ThmIndxr^TM, you need to tell us who you are. This information is collected so we can let you know when updates (new features, bug(!?!) fixes) and accessories (configuration tools, utilities, etc.) become available. It will also help us measure the level of interest in the program. Your entries will be used only for our internal records, and will not be distributed to other persons or companies.

If you have an existing L5 Software Development customer ID number, enter it here to save retyping your information.

After completing this form, an access code will be sent to the email address you enter which will enable you to download your shareware copy of ThmIndxr^TM. You will also receive a Transaction Code you can use when you register your copy of ThmIndxr^TM so you don't have to re-type this information.

We require a password any time you wish to use or change your customer information. This is done to make it more difficult for someone else to change your customer information. It also protects your privacy, since the information cannot be read simply by entering customer ID number(s) in forms such as this one and pressing the "Look me up!" button.

Your password must be between 6 and 32 characters, and can contain any ASCII printable characters. Password entry is case sensitive; i.e., "password" and "PASSWORD" are not considered the same by the password verification system.
You should pick a password that is easy for you to remember but hard for someone else to guess, since it is a key part of preventing anyone else from getting access to or changing your information in our database.

ThmIndxr^TM is copyrighted software, and you must treat it like a book: The license allows that the program may be used by any number of people, and moved between any number of computers, as long as it is only being used at one location at a time. If there is any possibility that the program may be used by more than one person, or on more than one computer, at any time, you must purchase additional licenses. The table below explains the pricing structure for multiple-use licenses for the program:

The prices above include Registration Keys up to the number specified by the license, plus one manual and program disk set. Additional documentation and program disk sets can be purchased for US $ 20.00 per set, up to the number of licenses purchased. This price includes shipping and handling anywhere in the continental United States. Please call for overseas and international shipping charges.

ThmIndxr^TM SOFTWARE LICENSE

You should carefully read the following terms and conditions before downloading or installing the program. YOU INDICATE YOU HAVE READ, UNDERSTAND, AND ACCEPT THE TERMS OF THIS AGREEMENT, WHICH INCLUDES THIS SOFTWARE LICENSE AND THE LIMITED WARRANTY (collectively known as the "Agreement"), BY DOWNLOADING OR INSTALLING THE PROGRAM. IF YOU DO NOT ACCEPT OR AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL OR USE THE PROGRAM.

L5 Software Development (the "Licensor") retains ownership of and title to ThmIndxr^TM and its utilities (the "Software"), including all subsequent copies on any media. The programs and their accompanying instructions, whether printed or electronic, are copyrighted materials. By purchasing a Registration Key, the price you (the "Licensee") pay buys the disks the programs and documentation are distributed on (if any), the printed copy or copies of the documentation included with your purchase from L5 Software (if any), and a non-exclusive License to use the Software under the following conditions:

YOU MAY:

• Use the Software originally distributed either electronically or on any physical media, provided only one person uses the Software on only one computer at a time.
• Freely use, alter, create derived works from, or otherwise embed the generated HTML code and/or files in applications you develop, or with other programming tools, without further royalty arrangements.
• Make a reasonable number of backup copies of the Software for archival purposes only.
• Use the Software on a network, file server or virtual (RAM) disk, provided access is limited to one user at one location at any time.
• Transfer the Software, its documentation, your Registration Key, and all copies thereof on a permanent basis to a third party, provided the new owner understands, agrees to and accepts the License terms, and the Licensor is notified in writing of the transaction.
• Make copies of the Software for other users, provided you supply all of the files, in their original form and organization, that are included in the SHAREWARE distribution package, AND provided that you do NOT distribute, give, supply, reveal or otherwise make available your Registration Key for the Software to any other person or entity.

SITE AND MULTIPLE-MACHINE LICENSE HOLDERS ALSO MAY:

• Allow use of the Software on more than one computer and by more than one user, provided access is limited to the number of users allowed in the site License Agreement (i.e., the number of Registration Keys that have been purchased).

YOU MAY NOT:

• Make copies of the Software, documentation and/or program disks, except as described above.
• Distribute, give, supply, reveal or otherwise make available your Registration Key (or Keys) for the Software.
• Loan, rent, sub-license, time-share, or otherwise transfer the registered Software or its Registration Key(s) (in any form, manner or media) and/or its documentation in or on any temporary form or basis.
• Alter, modify, or otherwise adapt the Software and/or its documentation, including, but not limited to, translation, decompilation, disassembly, or creation of derivative works.

LICENSE TERM:

The License granted is effective until terminated.

This License and your right to use the Software are automatically terminated if you fail to comply with any provision of the Agreement.

You may terminate your License at any time by returning the Software and its documentation, together with all copies, to L5 Software Development and destroying all records and copies of your Registration Key.

YOUR OBLIGATIONS:

• You, your employees, and your agents, are required to protect the confidentiality of your Registration Key, and to provide reasonable means to assure that copies of the Software are not made in violation of the License Agreement.
• You must retain all archival (backup) copies of the Software in your possession, and reproduce the copyright notice on each copy.
• Upon termination of the Agreement, you must immediately destroy all of the ThmIndxr^TM software, Registration Key (s), documentation, disks, and any copies thereof in your possession.

L5 Software Development retains all rights not expressly granted by this License. Nothing in this Agreement constitutes a waiver of L5 Software Development's rights under interplanetary, international or United States copyright laws and/or any other federal and/or state laws. The invalidity or unenforceability of any provisions of this Agreement shall not affect the remaining portions thereof.

LIMITED WARRANTY:

L5 Software Development warrants the following items:

• The Software will substantially conform to published specifications and in accordance with the documentation, provided that it is used on the computer hardware and with the operating system(s) for which it was designed, and that it is properly installed.
• The diskette on which the Software is distributed, and its documentation, are free from defects in materials and workmanship.

L5 Software Development will replace defective media or documentation or correct substantial errors at no charge provided you return the defective item with proof of purchase to L5 Software Development within 90 days of the date of delivery. If L5 Software Development is unable to replace defective media or documentation or correct substantial errors, L5 Software Development will refund the license fee. These are your sole remedies for any breach of warranty.

Except as specifically provided above, L5 Software Development makes no warranties or representations, either express or implied, with respect to this Software and/or the documentation, including their quality, performance, merchantability, and/or fitness for a particular purpose.

In no event will L5 Software Development be liable for direct, indirect, special, incidental, or consequential damages arising out of the use of or inability to use the Software and/or documentation, even if advised of the possibility of such damages. In particular, L5 Software Development is not responsible for any costs including, but not limited to, those incurred as result of lost profits or revenue, loss of use of the Software, loss of data, the cost of recovering such Software or data, the cost of substitute software, or claims by third parties, or costs incurred as a result of inappropriate use of images or data presented on pages created using the Software. In no case shall L5 Software Development's liability exceed the amount of the license fee.

The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied. No dealer, distributor, agent, or employee is authorized to make any modification or addition to this warranty.

Some jurisdictions do not allow the exclusion or limitation of implied warranties or limitation of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

TECHNICAL SUPPORT:

Technical support is available to properly registered users as a last resort, if you are unable to resolve problems with ThmIndxr^TM from reading its documentation. Requests for technical support must first be made through the Bug Report form on the L5 Software Development Web site, by email, or by postal mail before any problems will be addressed through (voice) telephone support. Please be sure you have checked thoroughly in looking for answers before calling for technical support, to save both your time and ours.

ON COPYRIGHTS AND SUCH MATTERS:

ThmIndxr^TM is copyrighted material. This is not to limit distribution of the program or use of its concepts: They are useful tools we'd like to see widely utilized. A lot of effort was expended developing this program so you could easily use it to simplify and enhance your work. Our copyrights are meant to support that effort to insure it's properly rewarded, to encourage future product development, and to support the private space exploration and development effort being conducted by The L5 Development Group
